Terms of Service

Welcome to CineShare™ — these Terms are between you and the operator of the CineShare service ("we," "us," "our").

Please read these Terms of Service ("Terms") carefully. They govern your use of the CineShare iOS and iPadOS application and our website at https://cineshare.net (together, the "Service").

By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be old enough to enter a binding contract in your place of residence and meet any minimum age we specify. You must provide accurate information and keep your login credentials secure. You are responsible for activity under your account, except where our systems are compromised through no fault of yours.

We support Sign in with Apple and email/password (and other sign-in methods we may add). Third-party sign-in is subject to those providers' terms.

You may delete your account through the in-app flow where we offer it. We may suspend or terminate accounts that violate these Terms, harm the Service, or harm other users.

2. The Service; changes

CineShare is a social movie discovery and tracking app: recommendations, watchlists, community features, reviews, cinema information, trivia, achievements, and optional Pro features, as described in our marketing and in-app materials.

We improve the Service over time. We may add, change, or remove features, impose limits (e.g. by Free vs Pro), or perform maintenance. We will try to give reasonable notice of material adverse changes when practical.

Film, cinema, and showtime information is provided by third parties (including TMDB and MovieGlu or similar). Showtimes and booking links may redirect to cinemas or ticketing sites; we do not control their availability, pricing, or terms.

3. Licence to use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the app for your personal, non-commercial use, on devices you own or control, in line with the Apple App Store rules.

You must not:

• Copy, modify, or create derivative works of the Service, except as allowed by law
• Reverse engineer, decompile, or attempt to extract source code, except where prohibited by law
• Interfere with the Service, servers, or networks, or use automated means in a way that imposes an unreasonable load
• Circumvent technical or entitlement limits, Pro access, or security
• Use the Service for unlawful, fraudulent, or abusive purposes

4. Your content; licence to CineShare

"Your Content" means text, images, reviews, comments, posts, lists, and other material you submit to the Service.

You retain your rights in Your Content, but you grant CineShare a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, modify, create derivative works of, distribute, and display Your Content as needed to operate, promote, and improve the Service (including moderation, ranking, and safety), in line with your visibility settings.

You represent and warrant that you have the rights needed to grant the above licence, and that Your Content does not violate these Terms or third-party rights.

We may remove or restrict any content that violates these Terms, applicable law, or our community standards, or for technical or security reasons.

5. Community and conduct

You agree to: treat other users with respect; not harass, threaten, defame, or discriminate; not post illegal content or other prohibited content; not spam, impersonate, or mislead; not distribute malware; and use report and block tools in good faith.

We may investigate reports and take action, including warnings, removal of content, suspension, or termination.

6. Intellectual property

CineShare, CineShare™, logos, and the app's look and feel are owned by us or our licensors.

Movie-related artwork, trailers, metadata, and attribution (including TMDB and MovieGlu credits) are subject to our partners' terms and licences; you must not use them outside what the Service allows.

If you believe content on the Service infringes your copyright or other rights, contact support@cineshare.net with the information required for a valid notice in your jurisdiction.

7. Subscriptions and payments (CineShare Pro)

Pro features and prices are shown in the app and on the App Store product page. Payment and renewal are handled by Apple under your Apple ID subscription settings. We may use a subscription management partner to validate entitlements and support restores; we do not receive your full card number from Apple.

Subscriptions renew automatically until you cancel in Settings → [your name] → Subscriptions on your Apple device, or as Apple otherwise specifies. Deleting the app may not cancel the subscription. Refunds are subject to Apple's policies.

We may change Pro features, pricing, or tier limits; we will show current terms at purchase and may give notice of material changes where required.

8. Free tier; no in-app ads

The Service offers a Free tier and optional Pro. The product is ad-free for Free and Pro; if that ever changes, we will describe it where required.

9. Disclaimers

THE SERVICE (INCLUDING TMDB / MOVIEGLU DATA, SHOWTIMES, TRAILERS, BOOKING LINKS, RECOMMENDATIONS, TASTE MATCH, AND COMMUNITY CONTENT) IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

Third-party and user content may be inaccurate or incomplete. We do not endorse all community reviews. Cinema and streaming availability varies by region and time.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CINESHARE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE (OTHER THAN LIABILITY THAT CANNOT BE LIMITED BY MANDATORY LAW) IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR AUD 100 IF YOU PAID NOTHING TO US), OR (B) THE MINIMUM ALLOWED BY APPLICABLE LAW.

11. Indemnity

You will defend, indemnify, and hold harmless CineShare and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from Your Content or your violation of these Terms, except to the extent caused by our gross negligence or wilful misconduct (as determined by a court of competent jurisdiction).

12. Governing law and disputes

These Terms are governed by the laws of Australia, without regard to conflict-of-law rules. Mandatory consumer protections in your country of residence may still apply. Your counsel may add a specific state or territory and dispute forum if required.

Informal resolution: before filing a claim, contact support@cineshare.net to try to resolve the dispute.

Class action waiver (where allowed): you and CineShare agree to bring claims only in your individual capacity, not as a plaintiff or class member in any class or representative action, unless the law in your place of residence does not allow this waiver.

Apple: These Terms are between you and CineShare, not Apple. Apple is not responsible for the Service. Apple has no obligation to provide support for the app. For failure to conform to a warranty (if any), you may notify Apple; Apple may refund the purchase price per its policies, and will have no other warranty obligation.

13. General

• Entire agreement: These Terms and the Privacy Policy (and in-app paywall text at purchase) are the entire agreement for the Service.
• Assignment: we may assign these Terms (e.g. in a sale). You may not assign without our consent.
• Severability: if a part of these Terms is invalid, the rest remains in effect.
• Waiver: failure to enforce a right is not a waiver.
• Notices may be in-app or by email to the address on your account.
